Arthur -v- Layte PZ200604

On 2 November 2001 Mr Arthur had "given" Mr Lanyon a ladder and a fire extinguisher from the shop in "payment" for acting as an independent witness when we confiscated the tenants property in lieu of about 16,000 unpaid rent. Mr Arthur also asked J Layte to remove certain items from the shop for "safe keeping". One such item was the shop till containing the last days takings (Less 76) that Mr Arthur had sealed bags.

On 14 June 2002 Mr Arthur had agreed a settlement with the "tenant" but did not tell the Laytes about it.

On 21 June 2002 Mr Arthur wrote asking for a list of the items removed on 2 November 2001 "in relation to the Potts tenancy". He said he was still trying to agree a rent settlement with Potts whereas he had settled a week before with Farr and Amor.

On 27 June 2002 Mr Arthur had insisted the items be returned because they belonged to the tenant and if we did not then it would be theft.

On 1 July 2002 the items were returned to the shop. The till is on the counter.
